You hear publishing everywhere, but to keep it real a bunch of people do not know what this really mean. We are here to explain it to you in plain English.


PUBLISHING WHAT IS IT? :

When a music artist creates any new music, they initially have a basic copyright, but once you get your work professionally copyrighted to show ownership which is very important.
( see our blog post ), then you will need to find a publishing company                                                   to help represent your work to be used commercially. PUBLISHING COMPANIES make sure you as an artist get paid anytime your music is used commercially. To start the process once you found a company you like, then you will need to sign a publishing contract. With a publishing contract the ARTIST SONGWRITER COMPOSER, assign the copyright of your work to the publishing company, in return the company licenses the compositions and tracks when they are used anywhere commercially they also collect royalties and distribute them to the creators of the music composition. 


HOW TO BECOME PUBLISHED? :

To get published is not as difficult as some say, all you need is                                                          original work written or composed by you, if you use samples then you need copyright clearances for these songs with proof. TAXES 101 FOR INDEPENDENT MUSIC ARTIST

           YOU ARE MORE THEN AN ARTIST YOU ARE A                                                    BUSINESS.


Taxes is a word that has humbled many in the USA for years and it seems like it is getting worse as taxes are getting higher, the more you make the more they take. Who is they 
UNCLE SAM, THE MAN, JOHNNY HANDOUT whatever you call the GOVT. lol. 

The truth is that if you know what your doing the pain of doing taxes and setting them aside doesn't have to be that bad. 

One of the first thing you have to do when you decide to become a music artist on the business side of things is look up tax laws for musicians and performers. Here you will find a few vital points of info that will help you on the way. 

Form 1040  - Covers self employed - which is you the music artist, even if you have a day job. 

Schedule -c  - Help report how much money you made or lost in the year doing business

Schedule C ez - You can use this form if your a company of ONE or Sole Proprietor 

Schedule SE - Help calculate the amount of self employed taxes owed to govt. as small business


Once you get familiar with the phrases, terms and govt websites etc. Now you have to put in some paper work and computer time.  A little effort  is needed to finally get your small business tax id, even a single person. YOU ALONE, can qualify for a small business id; and you don't have to pay a 3rd party business to get this done for you. Take about 20 minutes to get online and fill out the forms yourself. After you file to get your small business id it will take between 30-45 days to arrive. 
now you are officially a small business. ( simple right? ) 

Now that you are MUSIC.INC ( example)  you need to start keeping books, nowadays it is so much easier with even apps like quickbooks, intuit, turbotax etc that allow you to enter deductions etc from your phone or tablet asap. 

After you start to master how to enter your deductions into your small business tax forms via digital it is very important to turn one of your ( JORDAN SHOE BOXES OR SAFE) lol. into a receipt box. Why you ask? in case of an AUDIT. 

Receipt tip- always right on the back the date, store or place or purchase and the amount- 
( for some dumb reason the ink on receipts fades after 60 days or so) 
also keep your receipts for at least 3 years. 

When making purchases it isn't necessary to have a separate bank account or card, but it does make it easier to keep track of what your spending  and what can be deducted. You don't want to mix personal use items with your business items, the IRS does not play and they may let you get away with fraud for a little bit then drop the hammer on you, that is why the receipts and keeping records is so important. 

Most people who run business attempt to set aside some time every 3 months to add all the receipts, deductions etc on the tax forms and that way you won't fall behind, some even pay taxes owed quarterly.  Music artist can choose this method, but if your blessed to be on the road, or have a day job and not enough time for this. then keeping all receipts or at least having a separate account with all bank statements that reflect business use will keep you covered when April 15th shows up. NOW WE ALL HAVE UP TO APRIL 18TH and if you are late filing you have an amnesty option. So I guess UNCLE SAM is not that bad after all.

To COPYRIGHT = To own your creation outright, in this case copyright is to own your music.


Under international law, copyright is thee automatic right of the creator of work. That means that as soon as you write down a song or make a recording it is copyrighted.
in order to enforce this copyright tho you need to register it to prove ownership.
here is how to do this process.





               BELOW ARE THE EASIEST 7 STEPS TO GET YOUR MUSIC OFFICIAL
                                                                  COPY-WRITTEN.



  1. Make a copy of your song, you can make a cd, usb drive or mp3 mp4. All these methods may be used to create a hard copy. As soon as its recorded it is copyrighted, now you have to register it. 
  2. Go to US GOVT. SITE http://www.copyright.gov/. click on electronic copyright office,here you can make electronic copyright filing. To register is simple and it wil only take 4- 5 months to be processed instead of waiting 12 months or more via snail mail. 
  3. Register a free account once you have account registered you can use this for all your copyright needs.
  4. Complete your online application, click on register a new claim, copy wright services. answer a few questions and proceed to complete process.
  5. Pay the $35 fee to register it can be via debit/ credit etc.
  6. Upload a copy of your work many forms are accepted, If you don't want to send an electronic copy you can send a hard copy ( but this may delay processing time) 
  7. Wait for copyright to be processed now you are complete, protected and ready to go.
TIPS: instead of copyrighting each song you can copyright per album this will still cover each song individually and protect the all works that the album contains. So for $35 you can protect the album and all songs in this album.

We are not telling you to be cheap, but we are giving you ways to not blow your money away on things that aren't really needed, until you have money you can literally throw away


1. Copyright-  

the easy way to save instead of copyrighting each track, wait and then copyright your whole album, it is legal it will cover all tracks on that album and you won't have to pay separate filing fees for each copyrighted track. 

2. Album Art-  

In the digital age if you are printing cd's then don't waist money on a 3-5 page cd booklet explaining every part of your life etc. keep it simple and neat $45-$75 should cover your cost for designs. and then a one page insert for cd's covers double side printed will be more then enough. 

3.  PAPERWORK -  

Take time to do research google works wonders, and instead of paying out to have other companies do the simple task of filing forms for you, you can do them yourself in a little bit of time, which can save you a good amount of money. ( see our write up on taxes

4. CREW STREET TEAM OR ENTOURAGE- 

A GREAT SERIES, but in real life it can get very expensive quickly, when doing little shows you don't need 10 people with you. take maybe 3-4 at the most, DJ, CAMERA PERSON, and 1 or two road dogs one should be your manager, every one else can support by going to the show or buying the album. 


5. EXPENSIVE RENTALS FOR VIDEOS  -  

Every one is balling on videos, but 100% of US the music fans know that for the most part these cars etc are not the reality for 90% of the artist. ( not to discourage- but reality check some) Save your money on these high price rentals for videos, and come up with different concepts etc. at the end of the day the music is what people are most interested in , and you might find yourself owning one of those high end luxury cars with the money you save now.   

6. STOP PRINTING CD'S 

The CD era is dead, So to stay in budget don't print these anymore, if you must for some reason then remember #2 about simple covers etc. But to be honest cd's are usually used as place holders, weed plates or tossed within 2 days of getting them and most aren't listen to today because a lot of the new cars don't even have cd players any more.

The verdict is in and a bunch of you artist do not know how to correctly label your music videos, especially MP3'S or digital files for radio submissions etc.


here is a quick tutorial on how to correctly label your song


1. CHOOSE YOUR TITLE:   example ( HIT RECORD )

2. ARTIST NAME :               example ( BEST RAPPER ALIVE )

3. FEATURING:                    example ( 2ND BEST RAPPER ALIVE )

4. DATE:                              example ( JAN-1) this is optional- but some sites ask for it to keep track.


HOW TO PUT IT TOGETHER:

ENTER SONG TITLE FIRST/ ARTIST NAME/ FEATURED ARTIST / & OPTIONAL DATE

how it should look when it is displayed on digital radio screens or when the DJ'S download the file.

example: HIT RECORD / BEST RAPPER ALIVE/ FT. 2ND BEST RAPPER ALIVE / JAN 1.


even tho some radio stations may request  more info the format is pretty the much the same.

some media outlets may ask for you to include album name, to keep accurate track of where the single you submitted can be found.  if this is requested it should look like this

HOW 5,000 FANS CAN EQUAL A INDEPENDENT MUSIC CAREER

So you want to become a full time music artist? Well so does about 1,000 new people everyday.

This is not in anyway to discourage you this is to give you a reality check and possibly show you how to gain longevity in a industry that can be very fickle especially in the HIPHOP, POP, & ROCK genres.

As a new artist you want to aim as high as possible of course everyone wants to become the next multi-platinum selling artist doing world tours in places you never even heard of.

but in Reality only 1% make it to that level.

Now if you do not become part of the elite 1% don't fret, you can for sure make a career in music if your willing to work.

MUSIC IS 5% CREATION AND THE REST (THEE OTHER 95% IS BUSINESS)
so do your research and find out as much of the business as you can.

Now after you do your research try to figure out what you would be comfortable living with.

COMFORTABLE LIVING WITH = IN REALITY HOW MUCH DO YOU NEED TO MAKE PER YEAR TO SUPPORT YOUR LIFESTYLE AND KEEP CREATING MUSIC.

MINUS THE LAMBO'S FERRARIS AND MANSIONS and keep your yearly income sheet as real or as close to reality as possible; Factor in your actual living expenses, the cost of recording studios equipment and of course groceries etc.


for example I will use $50,000 BECAUSE IN REALITY MOST ARTIST ARE LIVING OR MAKING THIS OR LESS CURRENTLY AT THE DREADED DAYJOBS

So keeping $50,000 in mind now here comes the math on how to get to this amount every year.

At first you may have to create some debt by creating an album, most new artist with no industry budgets usually end up spending around 2,500- 5,000 per album created so to keep the figures even we will use the 5,000

Spend $5,000 to create an amazing album.  now you are at minus $5,000
I know your thinking, (but he said we was going to make money ) here comes the how to.

Now promote that $5,000 album everywhere you can, DJ'S, Social Media & everywhere possible

Hit up your friends old high school mates, college friends frats or sororities etc.
this is called BUILDING  A LITTLE  (FOUNDATION FAN BASE)

At the most you will need 100 real fans these 100 fans will net a return of $1,000 on your album if you sell your album for $10 standard cost is $9.99 per album.

$5,000 debt minus $1,000 foundation fans = -$4,000 on your way to actually making money

HOW? This Foundation fan base has friends and family, they play your music and others get interested, think of it as a family tree, now of course we all have bad branches, HATERS LOL, THESE WON'T BUY THE ALBUM BUT STILL MIGHT TELL OTHERS ABOUT IT, which may drive more people to hear your music at least & they may possibly like it.

Now to those down the line from the Foundation fan base that do LIKE YOUR MUSIC,
these will be your CORE FAN BASE for every 100 foundation fan base people you establish you can factor in 10% of the people they tell will like or support your music, WHY?  ( BIRDS OF A FEATHER FLOCK TOGETHER= IF A FOUNDATION FAN BASE PERSON LIKES YOUR MUSIC, THEIR FRIENDS WILL PRETTY MUCH LIKE THE SAME TYPE OF MUSIC) 

Now if your FOUNDATION FAN BASE TELLS 10 PEOPLE EACH ABOUT YOUR ALBUM THAT WILL GIVE YOU A POOL OF 1,000 LISTENERS, from that 10% will most likely become your CORE FAN BASE Factor the friends and people they tell and influence,
at least 10 SHOUT OUTS per CORE FAN BASE MEMBER & out of all the people they know another 10% will be drawn in. So with a 10% fan conversion rate for every 100 friends family and people that may have contact with your FOUNDATION FAN BASE / CORE FAN BASE
in a few weeks of good promoting you should now have a fan base of 1,000.

NOW WITH 1,000 FANS TOTAL HERE IS YOUR MATH = - $5,000 ALBUM COST
                                           100 FOUNDATION FAN BASE = + $1,000
                                            900 CORE FAN BASE               = + $9,000
                                           NEW TOTAL        =   $5,000 PROFIT ( TO FUND NEXT PROJECT)

NOW KEEP PROMOTING TO GET YOUR CORE FAN BASE TO 5,000 MEMBERS

5,000 MEMBERS IN YOUR CORE FAN BASE = $50,000 .


If you release 2 albums per year at a $5,000 cost per album then your will need 6,000 members in your CORE FAN BASE to net $50,000 per year. etc.

Use to be a series of songs or tracks an ARTIST or DJ made and distributed themselves                       for free or at a low cost around $5 per album to get gain and create a fan base & build a                       following. 

NOW: 2016    

The major labels are now using the method behind MIXTAPES to sell albums. 


HOW:            
Most labels are pushing artist to create as many songs as they can and once they have                          10-15 mid-level tracks they push these out and hope to make solid sales at least 25,000                        sales per release. They also aim to have 2-3 songs from this release to be powerful                                enough to get the artist on the road. For every release now the labels are looking to                              gain at least $250,000 off album sales and then another $150,000 or so from                                          performances of these songs. Labels are pushing artist to flip at least $400,000 per                                release. On average the labels will have these artist drop 2 MIXTAPE/ALBUMS per                    year. The end game is to make an estimated 1 Million off each artist signed.

A good artist who knows how to negotiate his or her contracts,                                                               Artist should push to receive at least 25% of the profit revenue generated                                             from a Mixtape styled album, if you have your own production                                                               crew then the percentage should be 50%.  
The label will make more then enough money from the other 50%.


MIXTAPE CONTRACT OUTLINE WITH MAJOR LABEL DISTRIBUTION: 

If  the artist comes with a complete MIXTAPE that includes all production cost mixing mastering etc. All the label has to do is push or distribute this MIXTAPE across all media outlets etc in 2016 labels still have more access to distribution outlets then any artist.
These type of Artist should demand or receive at least 75% of the album sales after cost.

Do not take an advance, if you was a broke artist before your music a few more months of being broke will not crush you.  Turn down the advance and await to get your royalties.
